These Terms of Service ("TOS") establish a legal agreement between you and Boom Stick Armory LLC ("Boom Stick Armory") for the Boom Stick Armory products or services accompanying this TOS. BY USING THE BOOM STICK ARMORY SERVICES, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS TOS. IF YOU DO NOT AGREE TO ANY TERM OR CONDITION IN THIS TOS, DO NOT USE THE BOOM STICK ARMORY SERVICES.
1. Boom Stick Armory Services Protection and License
The Boom Stick Armory Services are protected by copyright laws and international treaties. They are licensed, not sold. Boom Stick Armory retains all ownership rights.
Boom Stick Armory grants you a limited, nonexclusive, non-transferrable, non-sublicensable, royalty-free license to use the Boom Stick Armory Services solely for the purpose of evaluating or operating the accounts receivable management solutions supplied by Boom Stick Armory (the "Purpose").
You may not modify, reverse engineer, decompile, or disassemble the Boom Stick Armory Services. You may not transfer, sublicense, rent, lease, or lend the Boom Stick Armory Services. Boom Stick Armory reserves all rights not expressly granted. We may collect and use technical, business, financial, and personal information as described in our Privacy Policy.
4. Product Updates and Maintenance
Boom Stick Armory may provide updates or maintenance from time to time but is under no obligation to do so. This TOS applies to any updates unless otherwise specified.
Use for any purpose other than as permitted is a violation of this TOS. You are responsible for all data, connectivity, and security configurations. You must ensure data is accurate and free of viruses or malicious content.
6. Confidentiality and Feedback
The Boom Stick Armory Services contain confidential information that must be kept strictly confidential. You agree to protect this information and limit its use to the Purpose. You grant Boom Stick Armory a worldwide, perpetual, irrevocable, royalty-free license to use any feedback you provide.
All title, copyrights, and intellectual property rights in the Boom Stick Armory Services are owned by Boom Stick Armory and/or its suppliers.
8. U.S. Government License Rights
Provided with commercial license rights and restrictions as described.
You agree not to export or re-export the Boom Stick Armory Services in violation of U.S. export control laws.
THE BOOM STICK ARMORY SERVICES ARE PROVIDED "AS IS" AND "WITH ALL FAULTS", WITHOUT WARRANTY OF ANY KIND.
11. Exclusion of Claims; Remedies
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOM STICK ARMORY SHALL NOT BE LIABLE FOR ANY SPECIAL, INCIDENTAL, PUNITIVE, INDIRECT, OR CONSEQUENTIAL DAMAGES.
12. Governing Law and Dispute Settlement
This TOS is governed by the laws of the State of Ohio. Disputes are subject to the exclusive jurisdiction of courts in Hardin County, Ohio.
Please review our Privacy Policy, which governs your use of the Boom Stick Armory Services.
You consent to receive communications from Boom Stick Armory electronically.
You may instruct us to save bank account and/or payment card information ("Payment Information") for future use. You represent and warrant that you have the authority to do so.
This TOS constitutes the entire agreement between you and Boom Stick Armory.
